These Terms of Service govern your use of AliraLink's website and services. Please read them carefully.

Acceptance of Terms

By accessing and using AliraLink's website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Provided

AliraLink provides web development, payment solutions, operations support, and growth marketing services. Specific service terms are outlined in individual project agreements or statements of work (SOW).

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information

• Respond to requests for information in a timely manner

• Review and approve deliverables within agreed timeframes

• Provide necessary access to systems, accounts, and resources

• Pay invoices according to agreed payment terms

• Use our services in compliance with all applicable laws

SMS Terms and Conditions

If you opt in to receive SMS messages from AliraLink, you agree to the following:

Consent to Receive SMS:

• By checking the SMS opt-in box on our contact form, you expressly consent to receive text messages from AliraLink

• Consent is not a condition of purchase or use of our services

• You may opt out at any time by replying STOP to any message

Message Types and Frequency:

• We may send inquiry confirmations, project updates, notifications, and reminders

• Message frequency varies based on your project (typically 2-4 messages per project)

• We will not send promotional or marketing messages without separate consent

Cost and Carrier Information:

• Message and data rates may apply based on your mobile carrier plan

• AliraLink does not charge for SMS messages, but your carrier may

• Supported carriers: AT&T, T-Mobile, Verizon, Sprint, and other major U.S. carriers

Opt-Out and Help:

• Reply STOP to any message to unsubscribe from SMS communications

• Reply HELP for assistance

Limitations and Disclaimers:

• We are not liable for delayed or undelivered messages

• SMS delivery may be affected by carrier network issues

• We may terminate SMS services at any time with or without notice

Privacy and Data:

• Your phone number and SMS consent records are subject to our Privacy Policy

• We use Twilio as our SMS service provider

• We retain consent records for compliance purposes

Payment Terms

Payment terms are specified in individual project agreements. Unless otherwise stated:

• 50% deposit required to begin work

• Remaining balance due upon project completion

• Invoices are due within 14 days of issuance

• Late payments may incur interest charges

• We reserve the right to suspend services for non-payment

Intellectual Property & Ownership

Upon full payment, you own:

• All source code developed specifically for your project

• All content and assets you provided

• All custom design work created for your project

AliraLink retains ownership of:

• Pre-existing code libraries and frameworks

• Development tools and processes

• General knowledge and experience

We may showcase completed projects in our portfolio unless you request otherwise in writing.

Confidentiality

We agree to keep confidential any proprietary information shared during our engagement. This includes:

• Business strategies and plans

• Customer data and lists

• Financial information

• Trade secrets and technical information

Confidentiality obligations survive the termination of our services.

Warranties and Disclaimers

We warrant that:

• Services will be performed professionally

• Code will be free of known defects at delivery

• We have the right to provide the services

EXCEPT AS STATED ABOVE, SERVICES ARE PROVIDED 'AS IS' WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability

To the maximum extent permitted by law:

• Our total liability shall not exceed the fees paid for the specific service

• We are not liable for indirect, incidental, or consequential damages

• We are not responsible for third-party service failures

• You agree to indemnify us against claims arising from your use of our services

Project Changes & Scope

Changes to project scope after approval may result in:

• Additional fees based on our standard rates

• Extended timelines

• New statement of work

Significant changes require written approval from both parties.

Support & Maintenance

Unless specified in your agreement:

• Initial support period is 30 days from delivery

• Bug fixes for our code are provided free of charge

• Feature additions and enhancements are billed separately

• Ongoing maintenance requires a separate agreement

Termination

Either party may terminate services with written notice. Upon termination:

• Client pays for work completed to date

• AliraLink delivers all completed work

• Confidentiality obligations continue

• Unpaid invoices remain due

Dispute Resolution

In the event of a dispute:

• Parties will first attempt good-faith negotiation

• If unresolved, disputes will be settled through binding arbitration

• Arbitration will be conducted under AAA rules

• Each party bears its own legal costs

Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or infrastructure failures.

Entire Agreement

These Terms of Service, together with any signed agreements or statements of work, constitute the entire agreement between you and AliraLink. They supersede all prior communications and proposals.

Changes to Terms

We reserve the right to modify these terms at any time. Changes take effect immediately upon posting. Continued use of our services constitutes acceptance of modified terms.
